Is title skipping illegal in Florida? ›

(5) It is illegal to transfer title to a motor vehicle when the purchaser's name does not appear on the title. Any buyer or seller who knowingly and willfully violates this subsection with intent to commit fraud commits a misdemeanor of the first degree, punishable as provided in s. 775.082 or s.

Notarization is NOT required in the “Transfer of Title by Seller” section on the Florida title even if there is a place for notarization. Federal rule specifies that Odometer Disclosures for all non-exempt vehicles are to be made in the “Transfer of Title by Seller” section of the Florida Certificate of Title.

The seller must complete the Transfer of Title by Seller section on the front of the title certificate including, the name and address of the buyer, the odometer information, selling price and the date sold.

If the seller was phony, and has cut and run, then you should contact the DMV and ask for a bonded title. This allows for a period of time in which a claim can be made to the title, after which you can apply for a clean title of ownership and breathe a sigh of relief.

Exceptions to Title Requirements

Some states may require titling but will accept a bonded title or a surety bond during a sale. These bonds allow a person to claim ownership of a vehicle without a title if that title has been lost or stolen or wasn't required in the state in which it was originally registered.

Florida has been a title state since 1923, but the motor vehicle laws in other states or countries may require different documentation as proof of ownership. If the seller does not have a valid title, check with a local motor vehicle service center for specific instructions.

An electronic title is a title that exists only in electronic form on our database. An e-title is just as legal as a paper title pursuant to section 319.24, Florida Statutes.

Acquiring a Title

In Florida, to obtain a certificate of title you must, at minimum, have the following: Proof of identity: A driver license or identification card from any state, or a passport.

Step 3: Purchaser Visits the Tax Collector's Office

It's not required for the seller to be present, but it is recommended. Note: The State of Florida collects a 6% sales tax on the sale price of the vehicle, minus any trade-in for vehicles purchased through a dealer.

You can get a vehicle title from the State of Florida with a copy of the bill of sale. While it's much easier to go to the DMV with a copy of the original title signed over by the seller, you can use your bill of sale to register the vehicle in your name and have the title transferred over.

Once the Florida title is obtained, the gifter and giftee will need to complete the Transfer of Title By Seller form located on the front of the title. This form records the address of the giftee, the vehicle's odometer reading, and the date of the transfer.
